Travel Ban Expiration: Motion to Revoke Hanan Abdul-Wahab’s Travel Leave Withdrawn

Accra, July 16, GNA–The Accra High Court has struck out, as withdrawn, an application by the Attorney-General seeking to revoke the leave granted to former National Food Buffer Stock Company (NAFCO) Chief Executive Officer, Mr Hanan Abdul-Wahab, to travel to London.

The application, filed by the State, sought to revoke an order made by the court on June 29, 2026, permitting the first accused to travel to the United Kingdom for medical treatment.

Moving the motion, Dr Justice Srem-Sai, the Deputy Attorney-General, said the Republic relied on the motion paper and affidavit filed in support of the application.

The court, however, observed that there was no subsisting order to revoke because the travel order was self-regulating and had expired on July 12, 2026, the date by which Mr Abdul-Wahab was required to return.

The court held that since the order had lapsed by its own terms, there was no existing order capable of being revoked.

Dr Srem-Sai agreed with the court’s position and prayed for leave to withdraw the motion, noting that the travel order had expired.

Mr Godfred Yeboah Dame, Counsel for Mr Abdul-Wahab, opposed the circumstances surrounding the application, arguing that its objective had been to prevent his client from enjoying the benefit of the court’s earlier order.

He submitted that by filing the application and having it scheduled after the travel period had elapsed, the Republic had effectively frustrated the implementation of the court’s order.

Mr Dame argued that the application could never have succeeded because it sought to revoke an order that had already expired before the motion was heard.

He further contended that despite the lapse of the travel order, the Republic continued to disobey the court’s directive by retaining his client’s passport and other seized property.

According to counsel, the passport remained in the custody of the authorities, preventing the accused from benefiting from the leave earlier granted by the court.

Responding, Dr Srem-Sai rejected the suggestion that the Republic was responsible for the hearing date, stating that dates for motions were fixed by the court registry and not by parties to the proceedings.

On the issue of the passport, the Deputy Attorney-General told the court that the accused had been directed to report on the Monday following his arrest to retrieve the travel document but failed to do so.

The court subsequently granted the Republic’s request to withdraw the application.

It accordingly struck out the motion filed on July 8, 2026, seeking an order revoking the leave earlier granted to Mr Abdul-Wahab to travel to London.
