High court dismisses Chief Justice Torkornoo’s review application

Accra, Aug. 1, GNA – The Accra High Court has dismissed a judicial review application filed by suspended Chief Justice Gertrude Sackey Torkornoo, citing lack of jurisdiction and abuse of court process2. 

Presiding Judge Justice Kwame Amoako ruled that the court could not inquire into the in-camera proceedings of the Justice Pwamang Committee, which is probing petitions for the Chief Justice’s removal.  

“The application of the applicant (Chief Justice Torkornoo) was an abuse of the court processes,” the court held. 

The judge further stated that the reliefs sought had already been addressed by the Supreme Court, making the application duplicative and legally untenable. 

Justice Torkornoo had asked the High Court to quash the committee’s proceedings, arguing that the committee was not legally constituted under Article 146 and had breached the audi alteram partem rule. 

The Attorney General opposed the application, describing it as legally flawed and defective.  

“The matters upon which the originating motion and the reliefs sought for are based on matters which have either been previously decided by the Supreme Court or are properly pending before the Supreme Court for determination,” the Attorney General stated. 

He prayed the court to strike out the entire application, which the High Court subsequently did
