Accra, May 18, GNA — TDC Ghana Limited has filed a Notice of Appeal challenging an Accra High Court ruling in an ongoing land litigation involving the Nii Tetteh Santeo Family, Trasacco Estates Development Company Limited, TDC Ghana Ltd, and the Lands Commission.
In a public notice issued by management, the company stated that the ruling delivered by the High Court (Land Division) in Accra in Suit No. LD/0059/2015 specifically related to a 361-acre parcel of land occupied by Trasacco Estates Development Company Limited and not the entirety of Community 23 as being represented in some public discussions.
TDC Ghana explained that it continued to hold a valid and subsisting judgment in its favour in the case of Nii Blabi Din Borketey Nkpa v. TDC, Suit No. FAI/186/12, delivered on November 08, 2016.
According to the company, the judgment declared the whole of Communities 23 and 24 as forming part of the Tema Acquisition Area under the control and management of TDC Ghana Limited.
“The general public is further informed that TDC Ghana Ltd holds a valid and subsisting judgment in its favour against the family of Nii Tetteh Santeo in the case of Ni Blabi Din Borketey Nkpa v. TDC, Suit No. FAL/186/12, dated 8th November 2016, wherein the Court declared the whole of Communities 23 and 24 as forming part of the Tema Acquisition Area under the control and management of TDC Ghana Ltd. The said judgment remains valid and has not been set aside, overturned or reversed by any superior court,” it stated.
Management further assured stakeholders and the general public that all available legal remedies would be pursued in accordance with the laws of Ghana.
“Management wishes to assure the general public, stakeholders and all persons with interests in lands within the Tema Acquisition Area that TDC Ghana Ltd has duly filed a Notice of Appeal to challenge the said ruling and will pursue all available legal remedies in accordance with the laws of Ghana,” the statement said.
TDC Ghana urged the public to disregard misinformation, speculation, and unauthorised claims relating to ownership of lands within Community 23 beyond the specific 361-acre area currently under litigation.
The company reiterated its commitment to protecting lands under its management and safeguarding the interests of the state and the public.
It also advised persons engaging in land transactions within the affected enclave to exercise caution and undertake the necessary due diligence before entering into any agreements.
