Court dismisses defence application in Adu-Boahene trial

Accra, Oct. 30, GNA – A High Court has dismissed a defence bid to strike out portions of the prosecution’s response in the cybersecurity software trial involving Kwabena Adu-Boahene and two others.

The Court described the application as unmeritorious, legally unsupported and of no moment.

Mr Samuel Atta-Akyea, counsel for the accused persons, had sought an order striking out portions of the Republic’s written reply to the accused persons’ submission of no case to answer, filed on October 9, 2026.

The defence argued that some statements in the prosecution’s response were not supported by the record of proceedings.

Mr Atta-Akyea submitted that while counsel could draw inferences from evidence, they could not introduce evidence from the Bar or attribute statements to witnesses who had not made them before the Court.

He challenged the prosecution to identify where the disputed statements appeared in the record of proceedings.

The defence maintained that the Republic’s submissions should be confined to evidence placed before the Court.

The application stemmed from the Republic’s opposition to the accused persons’ submission of no case to answer, filed on September 25, 2026.

The Republic subsequently filed its written reply on October 9, 2026.

The Court, however, dismissed the application.

The accused persons filed their submission of no case to answer after the prosecution had closed its case.

The Court is expected to rule on the submission on November 5, 2026.

The ruling will determine whether the accused persons have a case to answer and will be called upon to open their defence.
