Accra, July 23, GNA – An Accra High Court has granted police assistance to UK-based Cola Holdings and its Receiver to take possession of the No. 1 Oxford Street Hotel in Osu.
The order was issued by Justice Faraday Johnson of the Commercial Division following an application by Cola Holdings after Kensington Residential Partners 1 Limited refused to hand over the property peacefully.
Justice Johnson held that under the Borrowers and Lenders Act, 2020 (Act 1052), Cola Holdings was entitled to seek a warrant of police assistance after being unable to obtain possession through peaceful means.
He noted that Cola Holdings had duly registered its security interest in the property at the Collateral Registry and obtained a Memorandum of No Objection to enforce its security.
The court dismissed the grounds advanced by Nana Kwame Bediako, Director of Kensington Residential Partners 1 Limited, who opposed the application, ruling that the company had failed to provide sufficient evidence to persuade the court.
Consequently, the court authorised police assistance to enable Cola Holdings and its appointed Receiver, Mr Nii Amanor Dodoo, to take possession of the hotel.
Counsel for Cola Holdings and the Receiver were Mr Tsatsu Tsikata and Mr Tata Kosi Foliba, while Mr Bobby Banson and Mr Isaac AkerefieMensah represented Kensington Residential Partners 1 Limited.
