Accra, Feb. 27, GNA – The Office of the Special Prosecutor has informed an Accra High Court that two proceedings are currently pending in the United States against Mr Kenneth Ofori-Atta, a former Minister of Finance.
The proceedings relate to alleged immigration violations and an extradition request.
The clarification was provided after the court sought updates on the status and availability of the first and second accused persons -Mr Ofori-Atta and his Chef de Cabinet, Ernest Darko Akore. The Special Prosecutor told the court that the United States Department of Justice, through the Attorney-General, had sought advice from the OSP on whether to arrest Mr Akore, a dual US-Ghanaian citizen, before serving him with a summons or to serve the summons prior to any arrest.
The OSP said it advised US authorities to adopt the most expedient and legally appropriate approach under their laws.
It further indicated that the DOJ had confirmed receipt of the extradition package and that the summons and charge sheet had been transmitted to Mr Ofori-Atta.
Proceedings in Ghana are, however, expected to continue.
Earlier in court, prosecutors refiled the charge sheet relating to the sixth accused, Kwadwo Damoah, after he applied before a previous judge to have his official title included.
The charges were therefore read afresh to reflect his designation as Col. (Rtd) Kwadwo Damoah.
The prosecution also informed the court that the broader charge sheet had been amended.
While the substance of the allegations remains unchanged, the number of counts has been reduced from 78 to 75.
Affected accused persons had their pleas retaken, with all maintaining their not guilty pleas.
The OSP further disclosed that two additional witness statements had been filed.
The case has been adjourned to March 26, 2026, while disclosures are expected to continue during the period of adjournment.
