AG challenges Court of Appeal’s stay of Aludiba trial at Supreme Court

Accra, Oct. 22, GNA – The Attorney-General has appealed to the Supreme Court against a Court of Appeal ruling staying proceedings in the criminal trial of Hanan Abdul-Wahab Aludiba, a former Chief Executive Officer of the National Food and Buffer Stock Company.

The notice of appeal, dated October 20, 2026, was filed by Deputy Attorney-General Dr Justice Srem-Sai on behalf of the Republic.

The prosecution is challenging the Court of Appeal’s October 19, 2026, ruling, which granted Aludiba’s application for a stay of proceedings pending the determination of his appeal against an earlier High Court decision concerning the charges.

The Attorney-General argues that the Court of Appeal erred in holding that a challenge to a charge sheet constituted an exceptional ground for staying a criminal trial.

The prosecution further contends that the ruling is not supported by the record before the court.
It is seeking an order from the Supreme Court to set aside the Court of Appeal’s ruling and direct that the criminal trial proceed.

The notice of appeal indicates that the prosecution may file additional grounds of appeal after receiving the certified copy of the ruling.

The appeal names Aludiba as the person affected by the proceedings.

The Court of Appeal panel that granted the stay comprised Justices Noble Nkrumah, Lydia Osei Marfo, and George Boadi.

Aludiba and his wife, Faiza Seidu Wuni, are facing criminal charges arising from investigations into alleged financial losses involving state funds.

The appeal follows the Court of Appeal’s decision to halt the trial pending the determination of issues raised by Aludiba concerning the adequacy of the charges against him.

The Supreme Court is being asked to determine whether the Court of Appeal was justified in staying the proceedings on the grounds raised.
