High Court dismisses Bediako injunction bid over English judgment

Accra, Aug. 15, GNA – An Accra High Court has dismissed Nana Kwame Bediako ‘s application to restrain Cola Holdings Limited from enforcing an English High Court judgment registered in Ghana.

The court also awarded GH¢20,000 in costs against Nana Bediako, a businessman and politician, in favour of Cola Holdings Limited.

Justice Mrs Awuah Dabanka-Bekoe, presiding over the High Court’s Commercial Division 3, dismissed the application filed by Nana Bediako through his lawyer, Mr Bobby Banson.

The application sought an injunction to prevent Cola Holdings from enforcing the English judgment pending the determination of Nana Bediako’s appeal against an earlier decision refusing to set aside its registration in Ghana.

The English judgment, dated January 23, 2025, was obtained by Cola Holdings against Nana Bediako personally and registered at the High Court in Ghana on May 20, 2025.

Nana Bediako had previously applied to the Commercial Division 3 to set aside the registration, but the court dismissed that application on November 27, 2025.

The London judgment ordered Nana Bediako to pay US$14,928,314.70, or its sterling equivalent at the date of payment, to Cola Holdings.

He was also ordered to pay continuing interest of US$3,271.96 per day from January 23, 2025, at eight per cent per annum on the judgment sum.

The judgment arose from a Deed of Indemnity executed by Nana Bediako in respect of his share of the repayment of a loan obtained from the International Finance Corporation (IFC).

Cola Holdings had guaranteed the loan granted to Kensington Residential Partners 1 Ltd, a company in which Nana Bediako and Azad Cola hold shares.

Following a default on the loan, the IFC called on Cola Holdings, as guarantor, to settle the outstanding amount, which the company subsequently paid.

The IFC subsequently assigned its interest in the loan to Cola Holdings, which sought to recover from Nana Bediako the portion of the loan covered by the indemnity.

Following the unsuccessful recovery efforts, Cola Holdings commenced proceedings against Nana Bediako at the High Court in London and obtained judgment in its favour.

Cola Holdings subsequently registered the judgment at the High Court’s Commercial Division in Accra for enforcement in Ghana.

Nana Bediako’s latest application was therefore intended to prevent enforcement of the registered judgment pending the determination of his appeal against the decision refusing to set aside its registration.
