Review application on Anti-Gay bill struck out

Accra, Feb. 26, GNA – The Supreme court has struck out Richard Sky’s review application contesting the passage of the Ghana’s anti- gay bill. 

This was after Mr Sky’s lawyer, Paa Kwesi Abaidoo, informed the apex court they have decided to “let sleeping dogs lie.” 

“We are withdrawing the review application. We have filed a notice of discontinuation.” Paa Kwesi Abaidoo told the nine-member panel. 

Dr Sylvia Adisu, Chief State Attorney, told the court that they had no objection if the case was being discontinued. 

However, she was not enthused that the plaintiff’s lawyer knew about the discontinuation yet dragged all of them to court this morning only to announce it.  

Dr Adisu therefore prayed for cost against Mr Sky. 

The Court quizzed counsel as to why his client, who is also a lawyer, failed to turn up in court. 

Professor Henrietta Mensah Bonsu described the discontinuation by plaintiff as “Justice abuse,” because the plaintiff had dragged people, including nine judges to court only to announce discontinuation. 

Other justices of the Court noted that the matter was a constitutional one which was of public interest not to only Ghanaians but of interest to people living outside country. 

Justice Paul Baffoe Bonney, who presided, therefore strike out the matter as withdrawn. 

Mr Sky had gone to the Supreme Court with the review application after the Court had ruled that its jurisdiction had not been properly invoked. 

The Court also held that the plaintiff’s case was premature because the anti-gay bill had not been passed into law. 

Parliament of Ghana in the 2024 passed the Human Sexual rights and family Values Bill, which criminalists and prohibits pro-gay advocacy and punish persons and institutions that support transgender and bisexuals among others.
