NDC goes to Court of Appeal over High Court’s ruling on mandamus application

Accra, Jan. 04, GNA – The National Democratic Congress (NDC) has filed a notice of appeal against the mandamus application directing the Electoral Commission to collate outstanding parliamentary results in four disputed constituencies.

The constituencies namely Tema Central, Ablekuma North, Okaikwei Central and Techiman South had outstanding parliamentary results in some polling stations.

While Tema Central has two outstanding polling stations, Ablekuma North had 62, Okaikwei Central had 31 and Techiman South had 147.

In a notice of appeal filed at the Court of Appeal,  the NDC held that it was appealing against the ruling on January 1 and 4, 2025 of the High Court.

The High Court presided over by Justice Forson Agyapong Baah on January 1, 2025, overruled a preliminary objection raised against the mandamus application.

The High Court held that the inherent jurisdiction of the court had been properly invoked because the application was not contesting already gazetted results of the EC.

The court went ahead to hear the mandamus application and on January 4, 2025, it directed the EC to collate outstanding parliamentary results in the four disputed constituencies.

According to the Court, the grounds for an application for mandamus had been met by the applicants in the respective cases.
