Cape Coast, Dec. 20, GNA— A Cape Coast High Court on Monday adjourned the case in which some 23 members of the Cape Coast Metropolitan Assembly had sued Mr Ernest Arthur, the Cape Coast Mayor, over his confirmation.
The court adjourned the case to Monday, January 10, 2022.
The Assemblymembers, who received an application filed by the Counsel of Mr Arthur to dismiss the case before
the court, failed to serve their lawyer on time, leading to its adjournment.
The court, presided over by Mr Justice Kwasi Boakye, upon a plea by the Plaintiffs’ Counsel, adjourned the case to next year to allow the lawyer to respond to the application.
Justice Boakye urged all to treat court proceedings and applications with urgency to avoid delays in case hearings.
He advised the plaintiffs to treat his court with seriousness because he was conscious of time and would always abide by the rules and conduct of service.
The Assemblymembers pleaded with the court to pardon them for not serving their lawyer and pledged to treat the Judge’s advice with seriousness.
The 23 members had sued Mr Arthur over misunderstandings that ensued during his confirmation.
They are praying the court to treat the MCE’s confirmation as void and illegal.
They contend that the election had no legal effect and called for it to be set aside and order for fresh nomination and approval.
