Accra July 29, GNA- The Supreme Court (SC) on Wednesday strike out an application challenging the retirement age of Dr Kofi Koduah Sarpong, Chief Executive Officer of the Ghana National Petroleum Corporation (GNPC).
Edem Agbana, a Deputy National Youth Organizer of the National Democratic Congress (NDC) had gone to court requesting for the resignation of Dr Sarpong for staying in office after attaining the retirement age of 65.
The seven member panel, presided over by Chief Justice Kwasi Anin Yeboah was informed by Mr. Kissi Adjabeng counsel for Agbana that he was withdrawing the action upon instructions from his client.
The court therefore struck out the application as withdrawn.
There was no order as to cost.
Agbana in his writ contended that Dr. Sarpong’s continued stay in office after attaining the retirement age is a breach of Article 199(1) and (4) of the 1992 Constitution.
He was therefore praying the court to compel Dr. Sarpong to pay back all salaries, allowances and benefits obtained from the GNPC per his post after he had attained that retirement age.
The NDC deputy Youth organizer was praying for an order compelling the GNPC CEO “to resign immediately from his position.”
President Nana Akufo-Addo appointed Dr. Sarpong as Acting Chief Executive Officer of GNPC in February 2017 replacing Mr. Alex Mould, a member of the NDC.
Dr. Sarpong was among eight CEOs working with public institutions that were supposed to retire by March 2019 because they had attained the retirement age and were asked to proceed on retirement by the Presidency.
